Rules of purchasing

GENERAL SERVICE INFORMATION AND FLIGHT RULES:


The hot air balloon flying season runs from May 1st to September 30th inclusive. Flights are carried out early in the morning (about 1-2 hours after sunrise) 5-9 am and in the evening (1-2 hours before sunset) 6-10 pm. A hot air balloon flies only downwind, so it is not possible to predict the exact flight route and exact landing location of the aircraft in advance. Typically, the hot air balloon lands in a meadow easily accessible to cars and the ground team. The balloon is prepared for flight in 20-30 minutes. The service price includes: a flight of no less than 40 minutes, pre-flight passenger safety briefing, passenger insurance (insurance does not apply to passenger belongings that are lost or damaged during the service), a glass of sparkling drink, passenger pick-up and drop-off at the agreed meeting place, flight thank you/certificate presentation. Suitable meteorological conditions are required for a safe hot air balloon flight, so the flight may not take place for safety reasons (e.g., due to changed meteorological conditions). In this case, the service provision may be delayed or postponed to another day. In this case, additional costs incurred by the customer (e.g., arrival at the agreed meeting place) are not compensated. Hot Air Lines does not guarantee the customer the provision of the selected service on a specific day chosen by him. Hot Air Lines also does not guarantee the provision of the service if the customer provided false, inaccurate, misleading, or incomplete required data during the service order, as well as if the passenger is late to the meeting place by more than 15 minutes. The clothing worn during the flight must protect the entire body. The most suitable clothing material is cotton. It is recommended to have a hat or cap with you to protect from the sun. Footwear must be comfortable, not restricting movement and not limiting mobility, preferably with ankle boots.

Although the institution takes reasonable measures to ensure a safe experience for our guests, some risk is inherent in every activity and cannot be eliminated without destroying its uniqueness. This inherent risk can result in lost or damaged equipment, accidental injury, illness, and in extreme cases, irreversible trauma or death. Hot Air Lines does not assume responsibility for activities that its customers choose to participate in, and these customers assume full responsibility for the risks indicated here and any inherent risks not specifically indicated. Any participation in any activity is entirely voluntary and depends on the participant's own choice, despite the inherent risks and knowing about them. You agree to take all prudent measures related to your safety during the service, including but not limited to, the proper use of safety equipment (including seat belts, harnesses, and/or flotation devices) and compliance with all verbal and/or written health and safety warnings. Hot Air Lines is not responsible for losses or damages incurred due to non-compliance with safety instructions, flight rules, and disregard for warnings:

- passengers under 6 years of age or those who are less than 110 cm tall cannot be accepted for a hot air balloon flight (persons under 16 years of age cannot fly without an accompanying adult);

- hot air balloon flight is an active service, so most of them require sufficient physical fitness: hot air balloon guests should be able to safely jump into and out of the hot air balloon basket (guests can assess their ability to climb safely or ask for help from our ground staff, who will be happy to assist if necessary. However, the company does not assume any responsibility for adverse health conditions, as guests participate at their own risk);

- pregnant women: it is not recommended for pregnant guests to fly in a hot air balloon, they will only be allowed to fly in the first trimester of pregnancy, and pregnant guests in the second and third trimesters of pregnancy will not be allowed to fly in a hot air balloon;

- the activity is not recommended for guests who have had major surgery in the past 6 months, persons who have had a broken leg or arm in the past 6 months, as well as persons suffering from chronic back or neck pain or injuries (if passengers have doubts whether their health condition is suitable for a hot air balloon flight, they should consult their family doctor or another qualified specialist and service provider before the flight);

- smoking is prohibited in the hot air balloon basket and within 20 (twenty) meters of the hot air balloon dome, basket, or trailer, and in our company's ground vehicles;

- it is strictly prohibited to consume alcoholic beverages before and during the flight (except when drinks are served as part of the service), and passengers under the influence of narcotic and/or psychotropic substances will not be served;

- it is strictly prohibited to use sharp and glass objects during the flight;

- it is prohibited to fly wearing high-heeled shoes;

- the safety of photo and video, and other personal equipment is ensured by the passengers themselves. Hot Air Lines does not assume responsibility for any items taken by passengers on the flight (in addition, their total weight must not exceed 2 kg);

- the company has the right to refuse to carry a guest whose behavior harms the safety and enjoyment of the group. By flying with us, you agree to recognize the pilot's authority and accept his decisions. Our employees have the right to a safe working environment, and our guests have the right to great experiences. Any threat to safety, physical or verbal, or inappropriate behavior may result in refusal to provide the service to the customer. If the pilot requires a guest to leave the flight, no money is refunded, and the guest is responsible for their travel expenses and means;

- the service is not provided to persons who for any reason cannot stand and hold on to the handles in the basket with both hands during the flight and landing. Passengers weighing more than 110 kilograms may be subject to an additional fee;

- You agree that during the flight, other participants, Hot Air Lines, or its representatives may take images, photos, or videos in which you may be captured or recorded. You agree to the taking of such photos and videos, and grant the company, its contractors, subcontractors, and successors a perpetual, royalty-free, irrevocable license to use them for any purpose in any medium now known or hereafter created without any additional obligations or compensation payable to you.

Hot Air Lines may refuse to provide the selected service to a person who does not meet the conditions and/or requirements for the provision of the service, and in this case, the money for which the service was purchased is not refunded. By ordering or purchasing the service, the customer confirms that he is aware that the service provider may refuse to provide the ordered service if such service provision in a specific case would pose a threat to the customer's health, life, or could cause other harm.

SERVICE PROVISION PROCEDURE

After registering online in the system and receiving information about the confirmed registration, Hot Air Lines contacts the customer using the contacts provided during registration: by phone, SMS message, or email. After agreeing on the flight date, on the day of the flight, all necessary information about the meeting place, time, and pilot's phone number assigned to the flight is sent to the customer by SMS message. The customer must arrive at the meeting place indicated in the SMS message at the specified time. If the customer is more than 15 (fifteen) minutes late or does not arrive at all, the flight is still carried out, and the customer's purchased service is treated as provided. The customer has the right to refuse to fly no later than 12 hours before the agreed meeting time for the flight. Otherwise, it is considered that the service was provided to the customer, and the money (or deposit) for the service is not refunded. The scheduled flight location may be changed due to objective reasons (meteorological conditions, airport flight management service instructions, etc.) even after the flight confirmation. If the flight location changes due to objective reasons, such flight location changes are mandatory for customers.

FLIGHT TICKET / GIFT VOUCHER

The flight ticket/gift voucher is a document transferred by Hot Air Lines to the customer, confirming that he or another person chosen by him has the right to the service specified in the specific flight ticket/gift voucher. This document can be both paper and digital and has its own unique number and the agreed number of passengers to be flown with the desired flight location. It also indicates the purchase and validity dates. This document is not personalized and can be transferred to another person at any time. In this case, all Hot Air Lines obligations pass to the person who took over the flight ticket/gift voucher. The latter acquires the rights and obligations provided for in these rules.
